Terms of Service

1. Acceptance of Terms
Welcome to CardCade. By creating an account, accessing, or using any part of the CardCade platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.
These Terms apply to all visitors, users, and others who access the Service ("Users"). If you are using CardCade on behalf of an organization (such as a school), you agree to these Terms on behalf of that organization and represent that you have the authority to do so.
2. Description of Service
CardCade is a gamified flashcard and learning platform that enables users to:
- Create, study, and share flashcard decks
- Participate in spaced-repetition review sessions and mastery quizzes
- Play retro arcade mini-games unlocked through learning progress
- Access AI-powered content generation tools (Solo Plus and Classroom plans)
- Participate in live multiplayer classroom game sessions (Classroom plan)
- Track study statistics, XP, streaks, and badges
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. Eligibility & Age Restrictions
You must be at least 13 years of age to create an account and use CardCade. By registering, you confirm that you are 13 or older.
If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Schools or educational institutions that register students under 13 must obtain verifiable parental consent in accordance with applicable law, including the Children's Online Privacy Protection Act (COPPA).
We do not knowingly collect personal information from children under 13 without appropriate consent. If we discover that a child under 13 has provided personal information without required consent, we will delete it promptly.
4. User Accounts
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately at matis@cardca.de of any unauthorized use
You may not share your account with others or create accounts for automated access without our prior written consent. CardCade accounts are non-transferable.
5. Acceptable Use
You agree not to use the Service to:
- Upload or share content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Infringe upon the intellectual property rights of any third party
- Impersonate any person or entity
- Attempt to gain unauthorized access to any part of the platform or its underlying infrastructure
- Use automated bots, scrapers, or other tools to access the Service without permission
- Interfere with or disrupt the integrity or performance of the Service
- Circumvent or abuse subscription plan limits
We reserve the right to terminate accounts that violate these rules without prior notice.
6. Content Ownership & License
Your Content: You retain full ownership of any flashcard decks, questions, or other content you create on CardCade ("User Content"). By submitting User Content, you grant CardCade a non-exclusive, royalty-free, worldwide license to store, display, and distribute your content solely as necessary to operate the Service.
You represent and warrant that your User Content does not violate any third-party rights (including copyright or trademark) and is not illegal.
CardCade Content: All software, design, branding, game mechanics, and other elements of the platform not created by you remain the exclusive property of CardCade and are protected by applicable intellectual property laws.
7. Subscriptions & Payments
CardCade offers free and paid subscription tiers. Paid features (such as Solo Plus) are billed on a recurring monthly basis through our payment processor (Stripe).
- Billing: Subscriptions renew automatically at the end of each billing period unless cancelled.
- Cancellation: You may cancel your subscription at any time via the account settings. Access to paid features will continue until the end of the current billing period.
- Refunds: Subscription fees are generally non-refundable except as required by applicable law or at our sole discretion.
- Changes: We reserve the right to change pricing with at least 30 days' advance notice to active subscribers.
8. AI-Generated Content
Certain paid features use artificial intelligence to generate flashcard decks, quizzes, and other educational content. You acknowledge that:
- AI-generated content may occasionally be inaccurate, incomplete, or inappropriate
- You are responsible for reviewing and verifying AI-generated content before using it in an educational setting
- CardCade makes no warranty regarding the accuracy of AI-generated outputs
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CARDCADE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
11. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.
Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice in the application at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York.
